Digital Business Card Subscription Terms & Conditions

These Subscription Terms & Conditions (“Terms”) govern the use of all Digital Business Card services, NFC business cards, hosted digital profiles, websites, subscription plans, and related services provided by Bizkonec (“Company,” “we,” “our,” or “us”).
By purchasing, activating, accessing, or using our Services, you agree to be legally bound by these Terms.
1. Definitions
For the purpose of these Terms:
“Digital Business Card” refers to the online profile, landing page, hosted digital profile, or smart networking page connected to an NFC card, QR code, or custom link.
“NFC Card” refers to the physical smart card containing NFC technology.
“Subscription” refers to the recurring hosting and maintenance service required to keep the digital profile active online.
“Services” refers to all digital hosting, profile management, NFC functionality, platform access, and related features provided by the Company.
“User,” “Customer,” or “You” refers to the purchaser or user of the Services.
2. Service Overview
Our Services provide users with:
A hosted digital business card profile and live custom profile link.
NFC smart card connectivity and QR code functionality.
Contactless information sharing and professional hosting/maintenance.
Technical support and platform access.
Note: The hosted digital profile link remains active only while the associated subscription remains valid and fully paid.
3. Subscription Requirement
The Digital Business Card service operates on a subscription basis. A valid subscription is required to keep your link active, maintain NFC functionality, and store profile data on our servers. If the subscription expires or remains unpaid, the digital profile and associated NFC services will become inactive.
4. Subscription Plans
We may offer monthly, annual, or lifetime plans. Pricing and features are displayed during purchase. The Company reserves the right to modify pricing or features with reasonable notice.
5. Automatic Renewals
Subscriptions automatically renew unless cancelled before the next billing cycle. By subscribing, you authorize the Company to automatically charge your selected payment method.
6. Payment Terms
All fees are payable in advance. Failure to complete payment may result in the suspension of the hosted profile, loss of NFC functionality, and deactivation of live links. All prices are exclusive of taxes unless otherwise stated.
7. Refund Policy
Unless otherwise required by law:
Subscription, setup, and customization fees are non-refundable.
Partial refunds are not provided for unused subscription periods.
8. Activation & Delivery
Digital profiles are activated after successful payment and completion of required setup info. Physical NFC card production and delivery timelines are estimates only.
9. Hosted Link & NFC Functionality
The subscription fee covers hosting infrastructure, server maintenance, and platform security. If your subscription expires, your hosted link, NFC tap functionality, and QR codes will be disabled.
10. User Account Responsibilities
You are responsible for providing accurate information and maintaining secure credentials. You agree not to use the Services for illegal activities, spam, phishing, or misrepresentation.
11. Profile Updates & Customer Requests
All Digital Business Card profile edits, updates, and modifications are managed exclusively by our team.
Customers do not receive direct access to edit or manage their hosted digital business card profile.
To request changes to contact details, social media links, images, logos, or business information, customers must contact our support team through official communication channels.
Update requests will be processed within a reasonable timeframe depending on workload and complexity.
We reserve the right to refuse any requested changes that violate laws, contain misleading information, include prohibited content, or infringe intellectual property rights.
12. Content Ownership
You retain ownership of the content you upload. By providing content, you grant the Company a non-exclusive license to host, display, and store such content solely for the purpose of operating the Services.
13. Acceptable Use Policy
Users may not upload illegal, fraudulent, offensive, or copyright-infringing content. The Company reserves the right to remove prohibited content without notice.
14. Intellectual Property
All platform software, branding, technology, and designs remain the exclusive property of the Company. You may not copy, reverse engineer, or resell the service without authorization.
15. Data Protection & Privacy
Your information is processed in accordance with our Privacy Policy. While we implement reasonable security measures, no online service can guarantee absolute security.
16. Service Availability
We aim for reliable uptime but are not liable for temporary interruptions due to maintenance, system upgrades, server issues, or third-party failures.
17. Third-Party Services
The platform may integrate with third-party providers (social media, payment gateways). We are not responsible for third-party policies or outages.
17A. Third-Party Assets & Premium Content
Certain customer projects may include third-party assets, including but not limited to 3D models, animations, icons, fonts, stock media, or licensed digital content.
While some assets may be available at no additional cost, premium or commercially licensed assets may require additional fees. Any applicable charges for such assets will be communicated to and approved by the Customer before implementation or purchase.
The Company is not responsible for changes in licensing terms, pricing, or availability imposed by third-party asset providers.
18. Account Suspension & Termination
We reserve the right to suspend or terminate accounts for violations of these Terms or failure to pay. Upon termination, hosted profiles and NFC functionality will be disabled.
19. Limitation of Liability
To the fullest extent permitted by law, the Company’s maximum liability shall not exceed the total amount paid by the Customer during the previous subscription billing period.
20. Indemnification
You agree to hold the Company harmless from any claims or legal fees arising from your use of the Services, your content, or your violation of these Terms.
21. Force Majeure
The Company is not responsible for delays caused by events beyond reasonable control, including natural disasters, internet outages, or cyberattacks.
22. Modifications to Services & Terms
We reserve the right to modify platform features, pricing, and these Terms at any time. Continued use of the Services after changes constitutes acceptance of the revised Terms.
23. Governing Law
These Terms shall be governed by the laws of your operating jurisdiction. Disputes are subject to the exclusive jurisdiction of the competent courts within that jurisdiction.
